Bikers can sustain serious injuries if involved in a car versus bicycle crash which is why they should understand legal options available to them should that unfortunate instance arise. A bicyclist recently struck by a car in Portland was in critical condition following the accident. The vehicle that struck the man did not stop following the crash. The hit-and-run driver was possibly driving a white pickup, according to witnesses. The vehicle was described as driving erratically before the bike crash. The crash is still being investigated and the hit-and-run driver is being sought. The intersection where the accident occurred has seen a number of bicycle accidents in recent years which have caused the city to make some changes to the intersection. Bicycle versus car collisions can result in serious injuries. As is the case with all personal-type injuries, the law of negligence governs. Both motorists and bicyclists owe a duty to obey the rules of the roadway and if either does not, may be liable for damages if an accident occurs and injury results. When a basic duty of care owed to everyone sharing the roadways is violated, the negligent driver may be liable to compensate a victim for any injury that resulted. Bicycle accidents can lead to serious injuries which can result in extensive and costly medical expenses and sometimes in long-term medical care. For these reasons, injured bicyclists can seek compensation, through a personal injury lawsuit, from the party that caused the harm. Just because a hit-and-run driver may not be located, does not mean that the victim did not suffer injuries and damages. Because of this, victims of hit-and run drivers, including bicycle accident victims, are able to receive compensation through a personal injury claim and uninsured or underinsured motorist insurance policy coverage. Bicycle riders can be especially vulnerable on the roadways.
