Car accident victims sometimes find themselves facing the unexpected challenges of car accident injuries. Two people were injured in a recent Portland drunk driving auto accident. The victims of the first crash followed the drunk driver and called 911. Before police arrived, the drunk driver ran a stop signed and crashed into a van, sending it into a building and injuring the driver and her passenger. The driver of the van was also cited for driving under the influence and her passenger remains in the hospital with life-threatening injuries. The drunk driver who caused the accident was arrested and is facing several charges. Car accident liability is based on the concept of negligence. Negligent drivers, such as drunk drivers, can be liable to injured victims (which can include parties in another car or even passengers in the drunk driver’s own car) for the injuries the negligent driver caused. Because every 10 seconds in the United States someone is involved in a car accident, there are, unfortunately, many car accident victims. Even if the victim is somewhat responsible for the accident, provided that the victim is not 51 percent or more responsible for the accident, the victim will be able to recover damages for the injuries suffered. The recovery, however, can be apportioned according to fault.
